Terms and Conditions
If you visit or shop at Retro and Rare LLC, you hereby acknowledge that you have read the following conditions and agree to be bound by them. Please print these Conditions using your computer's print function. www.retroandrarevideogames.com provides its services to you subject to the following Conditions Of Use ("COU") which include its Privacy Policy, which may be updated by www.retroandrarevideogames.com from time to time without notice to you. You can review the most current version of the COU at any time on this page. It is your obligation to check our COU and related policies and make yourself aware of any changes that may have been implemented.
Any deletions from, alterations, modifications, or additions to the COU shall not be binding to www.retroandrarevideogames.com unless they are expressed in writing and accepted by www.retroandrarevideogames.com authorized representative. If you do not agree to abide by our COU then you are not allowed to use this site or any services provided by www.retroandrarevideogames.com. If you don't agree to any future changes that may be made to these policies, then your remedy is to discontinue using this site and services provided by www.retroandrarevideogames.com.
As the legal owner of the device described above (“Device”), you authorize the party identified below, Retro & Rare, LLC (the “Store”) and its employees or a third party contracted by the Store (collectively with the Store, the “Store Parties”) to perform the repair work listed herein using all necessary parts.
We warrant our workmanship and parts used in all of our repairs against defects when used under normal conditions for 90-days from the original date the repair was completed or product was purchased. The warranty is non-transferrable and is void if the item is misused, altered or tampered with or if anyone other than one of the Retro & Rare team members previously has attempted or subsequently attempts to repair the Device. All of our console repairs and consoles sold via retroandrarevideogames.com have a warranty sticker affixed that must stay in tact in order for warranties to be redeemed. If a Device does not have a warranty sticker, it is understood under good faith that the above criteria is honored if claiming a warranty. We photograph all of our work and in most cases are able to prove if any form of tampering has been done. The estimated cost of repairs is based upon a visual inspection of the Device and does not include repair of any additional damage which may be discovered after the work has been started which exceeds $15 in parts and/or additional time exceeding 1 hour. Roach and insect infestations will require an additional 24hrs to eliminate and will add an additional $25 to the total repair cost. Should either scenario come into play, you will be contacted prior to continuing the repair. You acknowledge and agree that the Device may need to be opened to perform the repair, thus potentially voiding the manufacturer’s warranty.
You understand that the Store and Store Parties are not responsible for any loss of data stored on the Device which may occur as a result of work done on the Device. The Store recommends that, when applicable, customers back-up their data before submitting their device for repair.
You understand that the Store reserves, at its own discretion, the right to discontinue or refuse any service being performed on the Device based upon the condition of functionality and/or cleanliness of the Device.
You understand that any devices left unclaimed and unpaid for thirty (30) days after notification of repair completion are considered abandoned. You understand that you will be contacted, at minimum, four (4) times by the Store upon repair completion. Contact follow-up will be made until the Device is retrieved or until thirty (30) days have passed, after which it will be considered abandoned. All abandoned devices will be considered property of the Store and any applicable deposits will be forfeited. The Store will not be held responsible for any devices once they have been deemed abandoned.
Except for the limited warranty obligations of the Store described above, you release and agree to hold harmless the Store and their respective affiliates, parents, subsidiaries, officers, directors, employees, subcontractors and agents (collectively, the “Retro & Rare Parties”) from and against any and all damages, expenses, claims and other liabilities, including damages and claims respecting the Device or any data stored on the Device, that you may now have, hereafter have or claim to have against any of the Retro & Rare Parties. In all cases the maximum liability of the Store (including any Store Parties) hereunder is limited to the repair and replacement of defective parts or replacement of the Device with an equivalent refurbished device. An express lien is acknowledged on the Device to secure the cost of the repairs thereto. Should any individual provisions of this Agreement be or become invalid, this will not affect the validity of the remaining provisions of this Agreement. Any invalid provision will be replaced by such valid provisions as comes closest to the intentions of the parties hereto.
Any missing items or orders not received within 30 days by the purchaser or intended recipient must be reported to Retro and Rare LLC.
Placing an order does not enter into a contract with Retro and Rare LLC until the order is accepted. Retro and Rare LLC may choose to refuse the order, based on lack of inventory, pricing errors, or concerns about payment. Please read the Conditions Of Use for a full explanation of these items.
